QWhat Court should I file a Small Claims?

A:   A Small Claims case is normally filed in the precinct where the defendant lives.  In other cases, you may choose to file where the defendant contracted to perform services.  In order to locate the correct court in which to file, you must call the Voterīs Registration Office (210) 335-6625 and give them the exact address or use the Jurisdiction Locator tool.

QWhen should I file suit?

AThe suit must be filed within the time limited by the Legislature.  A court has no power to hear a suit that is filed, after these set time periods.  Many suits must be brought within 2 years after the dispute arose, others must be   brought within 4 years.  To be safe you should file suit as soon as you are convinced you cannot recover the money   on you own, and before 2 years have gone by.
