If Charged with a traffic violation other than  failure to maintain liability insurance, permitting unlicensed driver to drive, or violating a driverīs license restriction code, Texas law gives you an absolute right to take a Driving Safety Course to have the offense dismissed if you meet the following qualifications and correctly follow the instructions listed below in the section entitled Procedures.  (Keep in mind that your insurance rates can only be affected if you are convicted of a MOVING violation).

Qualifications:

  1. You have a valid Texas driverīs license or permit;
  2. You are not currently taking, nor have you taken a  Driving Safety Course to have a ticket dismissed within the one year immediately preceding the date of the alleged offense.
  3. You were not charged with speeding more than 24 miles over the posted speed limit.

PROCEDURES:

  1. On or before your court date, you must request the opportunity to take this course and pay the Court a $10.00 administrative fee plus applicable court cost of $105.00 TOTAL COST= $115.00, or $140 (if violation occurred in a school zone).   You will also be required to complete and sign a court prepared Affidavit (sworn statement)  {Affidavit Form} which states you meet the above listed qualifications (Make sure the Affidavit is Notarized if mailing in).
  2. You must complete a form {Driving Record Form} provided by the court and mail the form to the Department of Public Safety office in Austin, Texas along with a $10.00 check or money order.  A copy of your driving record will then be mailed to ou.  You must file this original driving record with the court.  The driving record will provide verification that you have not dismissed a ticket by taking a Defensive Driving  Course within one year immediately preceding the date of the alleged offense.
  3. Provide Proof of Financial Responsibility to the Court (Please mail in copy of insurance to Court)
  4. Within 90 days of the date you sign the court prepared Affidavit, you must complete a Texas State Certified Defensive Driving Course.  After completing the course, the certificate of completion will be mailed  to you.  You must  file  the Court Copy with  the Court (your signature MUST be on the COURT COPY of the certificate).

NOTES:  This court does not administer a  Driving Safety Course.  Check the Yellow Pages Under DRIVING INSTRUCTION for a listing of available schools. 

You are responsible for paying any costs associated with enrollment in a Defensive Driving course.

In the event that you follow the above procedures and it is later determined that either:
You have taken a  Driving Safety Course in the last year immediately preceding the date of the alleged offense to have a ticket dismissed, or assigned 90 day period, you will be subject to having a warrant issued for you arrest unless you IMMEDIATELY pay the original fine  (credit will be given for court costs you have paid). (You will forfeit the $10.00 administrative  fee).
